Luminara Portal provides nanny matching services connecting families with qualified childcare providers across Canada. Our services include:

• Background verification and screening
• Training and certification programs
• Ongoing support and consultation
• Access to our online platform and resources

3. Eligibility

To use our services, you must:

• Be at least 18 years of age
• Be legally authorized to work in Canada (for nanny applicants)
• Provide accurate and complete information
• Comply with all applicable laws and regulations
• Have the authority to enter into this agreement

4. User Accounts and Registration

4.1 Account Creation

To access certain features, you must create an account and provide accurate, current, and complete information.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in inappropriate conduct.

5. Services and Fees

5.1 Service Packages

We offer various service packages with different features and pricing. Current pricing is available on our website and subject to change with notice.

5.2 Payment Terms

• Fees are due as specified in your service agreement
• All fees are in Canadian dollars unless otherwise specified
• Payments are non-refundable except as expressly stated
• Late payments may result in service suspension

5.3 Refund Policy

Refunds may be available within 30 days of service commencement if no suitable matches have been provided, subject to our discretion and investigation of circumstances.

6.1 Prohibited Activities

You agree not to:

• Provide false, misleading, or incomplete information
• Circumvent our matching process or contact users directly without authorization
• Use our services for any illegal or unauthorized purpose
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to our systems
• Share your account credentials with others

6.2 Background Checks and Verification

Nanny applicants consent to comprehensive background checks, including criminal record checks, reference verification, and other screening procedures as deemed necessary.

7. Intellectual Property Rights

All content, features, and functionality of our services are owned by Luminara Portal and protected by Canadian and international copyright, trademark, and other intellectual property laws.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms.

9. Disclaimers and Limitations

9.1 Service Disclaimer

We provide matching services but do not guarantee employment outcomes. The final hiring decision rests with families, and we cannot guarantee the performance or conduct of matched caregivers.

9.2 Background Check Limitations

While we conduct thorough screening, no background check system is infallible. Families remain responsible for their own due diligence and decision-making.

9.3 Limitation of Liability

To the maximum extent permitted by law, Luminara Portal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to these Terms or our services.

10. Indemnification

You agree to indemnify and hold harmless Luminara Portal from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or infringement of any rights of another party.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us. Termination does not excuse payment obligations for services already provided.

11.2 Termination by Us

We may terminate or suspend your account immediately for violations of these Terms, illegal activity, or other conduct that may harm our business or other users.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein.

12.2 Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Quebec, Canada.

12.3 Mediation

Before pursuing legal action, parties agree to attempt resolution through mediation in Montreal, Quebec.

13. Force Majeure

We shall not be liable for any delay or failure to perform due to circumstances beyond our reasonable control, including acts of God, government actions, pandemics, or natural disasters.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after changes indicates acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Luminara Portal.
